Accelerated Rehabilitative Disposition (ARD)

Philadelphia DUI Attorney

Accelerated Rehabilitative Disposition ( ARD) is a program that enables you to have your DUI charges dismissed provided you complete the entirety of the program. In order to apply for the ARD program you must file an application with the Office of the District Attorney in the area where your DUI arrest occurred. The criteria for ARD eligibility includes:

  • No DUI conviction or placement in the ARD program for DUI within 10 years of the date of your most recent offense;
  • No children under the age of 14 were present in the car at the time of the DUI arrest ;
  • No involvement in an accident with serious injury or death due to driving while under the influence.

It is possible that the District Attorney's office will deny your application for reasons that are not included in the above. Your best chance of acceptance into the ARD program is to contact a Philadelphia DUI defense lawyer as soon as possible. The Lawyers at The Benari Law Group have represented a large number of people throughout the Philadelphia area in their DUI cases and have likewise assisted many with enrollment in the ARD program. We are available to help you in your DUI case and can inform you of the specific ARD policies, the involvement of the DA's office, and can assist you with the filing of your application. With our help, you will have an increased chance of acceptance and the possibility of having your charges dismissed and erased from your record .

First Time Offenders and ARD

ARD is a workable alternative to traditional prosecution for those facing a first time DUI offense. The program is similar to probation for a specified time, typically 1 or 2 years. You may take part in community service, and attend a mandatory alcohol education program. You may also serve a term of license suspension. All of this is preferable to being charged and possibly convicted for DUI, as the program will allow you to avoid having a conviction record.

Contact a Philadelphia criminal defense attorney if you were arrested for a DUI and wish to take part in the alternative ARD program.
